By submitting an idea, contacting us, or engaging our services, you agree to these Terms of Service. Please read them carefully.
1. Parties & Scope
These Terms of Service (“Terms”) govern the relationship between A&K Worldwide Enterprises FZCO (“BuildMyApp”, “we”, “us”, “our”), a Free Zone Company registered in Dubai, UAE, and any individual or legal entity (“Client”, “you”) that submits an idea, engages in communication, or enters into a service agreement with us.
2. Services Provided
BuildMyApp provides digital product development services including, but not limited to:
- Mobile application development (iOS & Android)
- Web platform and SaaS development
- Prop trading firm platform development
- Online casino and iGaming platform development
- Fintech product development
- Marketplace development
- AI product development
- Brand identity and UI/UX design
- Go-to-market strategy and growth marketing
The exact scope, deliverables, timeline, and pricing are defined in individual written project agreements signed by both parties.
3. Idea Submission & Evaluation
The free idea evaluation offered on this website is non-binding and does not constitute a contract or any commitment from either party. We reserve the right to decline any project submission at our sole discretion without providing reasons.
All submitted ideas are treated as confidential. Upon request, we are happy to sign a Non-Disclosure Agreement (NDA) before any detailed information is shared.
4. Co-Investment Model
Where applicable and mutually agreed in writing, BuildMyApp may co-invest a portion (up to 50%) of the agreed development costs in a project. In exchange, a revenue share is negotiated on a case-by-case basis.
The specific co-investment amount, revenue share percentage, duration, and conditions are always defined in a separate written agreement signed before work commences. No co-investment commitment exists without such a signed agreement.
5. Revenue Share
Where a revenue share agreement is in place, the agreed percentage of net product revenue is payable to BuildMyApp for the duration specified in the project agreement (typically 2–4 years from launch). After the agreed period, the Client retains 100% of all revenue. Revenue share is calculated on net revenue after payment processing fees and applicable taxes.
6. Payment Terms
All services are invoiced in milestones as defined in the individual project agreement. Invoices are due within 14 calendar days of issue. Late payments may incur interest at 1.5% per month. All prices are exclusive of applicable taxes unless stated otherwise.
7. Intellectual Property & Ownership
Upon receipt of full payment for each milestone, all intellectual property rights to the deliverables for that milestone transfer exclusively to the Client. This includes source code, design assets, brand materials, and associated documentation.
BuildMyApp retains no equity stake or ownership in the Client's product or business. Our participation is limited exclusively to the agreed revenue share as described in the project agreement.
8. Confidentiality
Both parties agree to keep confidential all non-public information shared during the engagement, including but not limited to business strategy, technical specifications, financial data, and customer information. This obligation survives termination of the agreement for a period of 3 years.
9. Warranties & Representations
BuildMyApp warrants that services will be performed with reasonable skill and care. We do not warrant that the product will achieve specific business outcomes, revenue targets, App Store rankings, or user acquisition numbers. All projections and estimates are provided in good faith and are not guarantees.
10. Limitation of Liability
To the maximum extent permitted by applicable law, BuildMyApp's total liability to the Client for any claim arising from or related to these Terms or any project agreement shall not exceed the total fees paid by the Client in the three months preceding the claim.
We are not liable for any indirect, incidental, consequential, special, or punitive damages, including loss of revenue, loss of data, or loss of business opportunity, even if advised of the possibility of such damages.
11. Termination
Either party may terminate a project agreement with 30 days' written notice. Upon termination, the Client is responsible for payment of all work completed to date. Deliverables for paid milestones are transferred to the Client upon termination.
12. Governing Law & Jurisdiction
These Terms and any disputes arising from them are governed by the laws of the United Arab Emirates. Any disputes shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.
13. Changes to These Terms
We reserve the right to update these Terms at any time. Changes are effective upon posting to this website. Continued use of our services after changes constitutes acceptance of the updated Terms.
